The Lagos State judicial panel on restitution for victims of SARS related abuses and other matters sitting in Lagos today Tuesday 6th July, 2021 struck out a petition for want of diligent prosecution by the petitioner.
In the petition of Idris Saula vs the Nigeria police force, the petitioner was again absent for the fourth time of the case being called. Though the petitioner counsel made a spirited attempt to seek a short adjournment on the grounds that she is at a loss for the absence of the petitoner, the respondent counsel from the Nigeria police force objected to the application for an adjournment, but rather applied for the petition to be struck out on the grounds that the petitioner has not shown seriousness to prosecute his matter, otherwise he won’t be absent again for the fourth time.
Ruling on the matter, the panel Chairman Justice Doris Okuwobi (Rtd.) dismissed the application of the petitoner counsel and rather found merit in the respondent application for the petition to be struck out because it was coming up for the fourth time and the petitioner is absent again.
The panel subsequently struck out the petition for want of diligent prosecution.
