The Lagos State judicial panel on restitution for victims of SARS related abuses and other matters sitting in Lagos today Tuesday 8th June, 2021, struck out a petition for want of diligent prosecution.
10 petitions were listed for hearing today, of which the panel was only able to conduct hearings into 9 petitions.
In the petition of Adefolurin Adesomonowo vs Intelligence Response Team (IRT), when the case was called for the 3rd time today, neither the petitioner nor his counsel was present as in two previous occasions. Thus, the respondent counsel applied for the petition to be struck out for want of diligent prosecution.
In her ruling, the panel chairman Justice Doris Okuwobi (Rtd.) noted that having taken cognizance of the application of the respondent for the case to be struck out because it has come up hearing for the third time today and the petitioner is absent and is not represented by a counsel as in two previous occasions, the panel is left with no other choice but to strike out the petition for want of diligent prosecution on the part of the petitioner.
Eight other petitions were heard and they are at various stages of adjudication.
